These Terms and Conditions ("Terms") govern your access to and use of the 1ClickBuilder platform, including all websites, APIs, and services operated by 1ClickBuilder Technologies Pvt. Ltd.
1. Acceptance of Terms
By creating a 1ClickBuilder account or using the platform in any way, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the platform. We may update these terms at any time with 30 days' notice via email.
2. Eligibility
You must be at least 18 years old and legally capable of entering contracts under Indian law to use 1ClickBuilder. By registering, you represent that you meet these requirements. Business accounts must be registered in a jurisdiction where our services are available.
3. Your Account
You are responsible for maintaining the security of your account credentials. You must not share your password or allow others to access your account. You are responsible for all activity that occurs under your account. Notify us immediately at security@1clickbuilder.com if you suspect unauthorized access.
4. Permitted Use
You may use 1ClickBuilder to create and operate legitimate online stores and wholesale catalogs. You must comply with all applicable laws including Indian e-commerce regulations, consumer protection laws, and GST requirements. You must not use the platform for illegal activities, selling prohibited goods, spam, phishing, or any activity that harms other users or the platform.
5. Prohibited Content
You may not list or sell: counterfeit goods, illegal drugs or controlled substances, weapons or items regulated under Indian arms law, adult content without proper age verification, products that infringe intellectual property rights, or any items prohibited under applicable Indian law. We reserve the right to remove any content and suspend accounts that violate this policy.
6. Payments and Fees
Platform fees are charged as per the plan you select. Payment processing fees are charged by our payment partners (Razorpay, Stripe, PayPal) and are separate from platform fees. We do not take a commission on your sales. All fees are exclusive of applicable GST. Fees are non-refundable except as required by law or as stated in our refund policy.
7. Subscription and Cancellation
Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your dashboard — cancellation takes effect at the end of the current billing period. Upon cancellation, you retain access until the period ends. Your data is available for export for 90 days after cancellation, after which it may be permanently deleted.
8. Intellectual Property
1ClickBuilder and its technology are owned by 1ClickBuilder Technologies Pvt. Ltd. You retain full ownership of content you upload (product images, descriptions, branding). By uploading content, you grant us a non-exclusive license to host, display, and distribute it solely to operate your store. You may not copy, reverse-engineer, or redistribute our platform technology.
9. Uptime and Service Levels
We target 99.9% monthly uptime for paid plans. Planned maintenance is performed during low-traffic windows with advance notice. We are not liable for downtime caused by factors outside our control (internet outages, force majeure, third-party service failures). Enterprise customers may negotiate custom SLAs.
10. Limitation of Liability
To the maximum extent permitted by Indian law, 1ClickBuilder's total liability to you for any claims arising from use of the platform is limited to the fees you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or data loss.
11. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India. We encourage resolving disputes amicably first — contact us at legal@1clickbuilder.com before initiating legal proceedings.
